Medical Board Misconduct DescriptionThe Hearing Committee sustained the charges finding the physician guilty of fraudulent practice; negligence on more than one occasion; gross negligence; willful failure to comply with federal law and regulations; excessive tests and treatment and failure to maintain records. On July 28, 2011 the State of New York Supreme Court, Appellate Division affirmed the Hearing Committee's July 22, 2009 determination finding the physician guilty of misconduct but annulled certain findings in the specifications of misconduct. These annulments do not alter the penalty of license revocation and $240,000 fine.
